A Bihar court on Tuesday issued the warrant against
Raj for allegedly spewing venom on Bihari migrants in Mumbai and other places.
MNS leaders said the party would move an appropriate court to have the warrant
cancelled. Mumbai police commissioner D Sivanandhan said he would act as per
legal procedures after he received the warrant.
The warrant was
issued by first-class judicial magistrate (Muzaffarpur) Sahab Kaushar because
Raj had failed to comply with an earlier order of the court to represent his
side. The court has ordered that Raj be produced before it on November 2. The
assembly results are scheduled to be announced on October 22.
Sudhir
Ojha, a senior advocate, had on February 2, 2008 filed a complaint under Section
504 (intentional insult with intent to provoke breach of peace) in the court of
the then chief judicial magistrate (Muzaffarpur) J K Sinha seeking legal action
against Raj. Ojha alleged that Raj had on Janaury 31, 2008 made hate speeches
against Biharis. He had also insulted the holy `Chhath' festival, which is
traditionally celebrated by Biharis, Ojha alleged. Sinha had then transferred
the case to the first-class judicial magistrate.
